The Midnight Shop

These Terms and Conditions outline the agreement between the artist ("Artist") and the client ("Client") regarding commissioned artwork. By commissioning the Artist, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.

Commission Process​

• The Client will fill out the form to initiate the commission process. The Client must provide a clear and detailed description of the desired artwork, including references if necessary, through email or chats.

• Once the commission is accepted by the Artist, a notice of commencement will be forwarded to the Client, along with the price and a PayPal invoice through a link.

• Once the Artist receives the non-refundable 50% of the payment and confirms the same, the Artist will begin working on the artwork.

• The Artist will provide an initial sketch or concept (if applicable) for approval before proceeding with the final piece.

• The Client is entitled to revisions during the sketch phase. Beyond the sketching phase, the Artist shall not accept any more major revisions.

• Once the final piece is completed, only minor changes are allowed; any major revisions will not be accepted.

• The Artist will provide periodic updates to the Client on the progress of the artwork.

• The estimated completion time varies based on complexity and will be communicated to the Client before payment.

• Rush orders are not available.

• Delays due to unforeseen circumstances will be communicated to the Client as soon as possible.

• The Artist reserves the right to decline a commission request.

 

Copyright and Credits

• The Artist retains all copyright and reproduction rights to non-commercial commissioned artwork. All non-commercial artwork will bear the Artist's watermark.

• The Artist must be credited as "Illustration by Midnight Brushes" and/or tagged (@midnightbrushes) on social media platforms by the Client.

• The Client may use the artwork for personal purposes only unless a commercial license is agreed upon.

• The Client is not allowed to resell, reproduce, gain monetary profit, or alter the artwork without explicit permission from the Artist.

• The Artist reserves the right to use the artwork for portfolios, social media, or promotional purposes unless otherwise agreed upon.

• The Client may not use the commissioned artwork by the Artist for NFTs or Al training.

• For commercial artwork, the Artist will require an additional 100% of the commission price as a licensing fee.

 

Pricing and Payment

• All prices are in CAD, payable via PayPal.

• Prices are determined based on the complexity, size, and medium of the commission (please check Pricing for more information).

• A non-refundable deposit of 50% is required upfront before work begins.

• Full payment must be completed before the final artwork is delivered.

 

Refunds and Cancellations

• Both parties understand that either the Client or Artist may terminate the service at any time if, for any reason, the relationship is deemed unsatisfactory by either party. Upon written or verbal cancellation, the Client is responsible for payment for all expenses incurred and any work done towards the completion of the project, based on the percentage of the project completed as determined by the Artist.

• No refunds will be issued once the final artwork is delivered.

 

Delivery

• Digital commissions will be delivered via email or Google Drive in high-resolution format once full payment is received and confirmed by the Artist.

• In case of any delay, the Artist will promptly communicate the issue to the Client.​

Modification of Terms

• The Artist reserves the right to update or modify these Terms and Conditions at any time without prior notice.
